IEP or 504: Understanding the Difference

A student has been found eligible for a 504 Plan but how does that differ from an IEP? This is a common area of confusion for parents. Should a teacher, therapist or medical provider suspect a disability, a parent/guardian can request their child be evaluated by the school for special education services. If the child was not found eligible, the student may qualify for a 504. The school is still required to provide FAPE (Free and Appropriate Public Education) to the child – with a few differences.

What’s The Difference Between an IEP vs 504?

While both Individualized Education Programs (IEPs) and 504 Plans provide student’s with specific accommodations, an IEP is a plan for special education at school to meet a child’s unique needs, while a 504 is a plan for how the school will provide support and remove barriers for a student with a disability to learn alongside their classmates.

The Individualized Education Program (IEP)

To qualify for an IEP, there are two requirements the student must meet under the IDEA (Individuals with Disabilities Education Act);  The student must have one or more of the thirteen disabilities specified in the IDEA and the disability must impact the student’s ability to learn and benefit from the schools education curriculum. 

If the child is found eligible for special education, an IEP is developed by the special education staff and sent to the parents/guardians for approval. 

An IEP is a written, legal document reviewed annually that identifies a child’s unique and individualized needs. The IEP identifies goals based on these needs that inform the type and frequency of services (speech and language, occupational, transportation, extended time, etc). 

It is important to know that services will not begin until the parents/guardians responds in writing – either accepting the IEP in full or partial acceptance or declining services. The signed IEP is due back to the school (30) thirty school days from receiving notification. 

Occasionally, areas of disagreement may pertain to the specific level of services – particularly if the recommended services were advised by a third party. When common ground cannot be achieved, the school district may perform an outside evaluation, called an Independent Educational Evaluation (IEE). Should the parents/guardians disagree with the treatment program, the IEP allows families to dispute the plan. A resolution option may be mediation; a due process hearing or a complaint to the state education department or seeking advocacy through the Office of Civil Rights.

504 Plan

A 504 Plan is a plan, defined in Section 504 of the Rehabilitation Act of 1973, that enables a student to successfully access the curriculum through specific accommodations and/or related services. To qualify for a 504 Plan, the student must have a disability that which substantially limits one or more major life activities and the disability limits the student’s capacity to learn in a general education setting. 

The 504 process is less formal than the IEP process. The 504 program team is not as strictly defined as with an IEP and while schools typically include parents in the process, parental inclusion is not required with a 504. Documenting the 504 in writing is also not required.

Should parents/guardians not agree with the plan, they do not have the right to an IEE. The options for dispute resolution are very similar to that of an IEP – mediation; a due process hearing or a complaint to the state education department or seeking advocacy through the Office of Civil Rights.

School leaders in today’s age are tasked with solving several challenges in public schools that range from a wide variety of issues. We have identified challenges within two categories:

  • Professional challenges – the public facing challenges most often addressed in open forums and monthly board meetings.
  • Actual challenges – the day-to-day challenges requiring urgent attention often diverting time and resources prohibiting school leaders from being effective leaders, decision-makers, communicators and collaborators to ensure the overall success of their school districts.

“Professional” Challenges facing Public School Leadership

It’s not easy being a Leader and setting direction with Public Schools. School Leaders are tasked with a myriad of issues that their predecessors and mentors were not entrusted with guiding a pathway for effective solutions. “We are learning on the fly” is the new normal.  It is important to note that the specific concerns can vary depending on the location, budget and individual circumstances of the respective public-school environment.

1. Budget constraints

Public schools often face budget limitations and school leadership must find ways to manage limited resources while ensuring a quality education. They need to make difficult decisions regarding funding allocations, staffing, and educational programs to maximize the impact of available resources.

2. Academic achievement

School Leaders are responsible for improving academic outcomes and ensuring students meet or exceed educational standards. They must address issues in achievement gaps, student retention, graduation rates, and test scores. Unveiling Public Education System Hurdles

The state of our public education system has plenty of room for improvement and developing a plan to move schools in the right direction is easier said than done. 

The first challenge is identifying underlying problems in public schools preventing our students from learning. This challenge, in part, is because the problems may change depending on who is identifying them – educators, parents or lawmakers. 

The following list of challenges facing public schools is based upon the perspective of educational leaders currently working in the public-school systems.

1. Poverty

The United States Department of Education states 16 percent of the children in the U.S. live at or below poverty level – nearly 12 million children! Estimates project this number to exceed 25% within the next 10 years; Over 50% of students qualify for free lunch programs. 

Students living at or below poverty level tend to have the highest dropout rates. Students who do not get enough food or sleep are less likely to perform at their full academic potential. 

Schools know these truths and despite efforts to provide students with basic essentials, teachers, administrators and lawmakers know there is simply not enough to go around.

2. Classroom Size

Many areas of the country are facing classrooms that have exceeded the appropriate level of student teacher ratio. When money gets tight, classroom numbers are often the first impacted. 

Most public school teachers will agree they cannot effectively teach every student in a classroom if the class size exceeds 25 students. Their statements are backed by multiple research studies indicating class sizes of 15-18 students in grades K-5 provide both long and short-term benefits to both the students and the teachers. 

We have also found minority and English as a second language (ESL) students benefit the most from smaller classroom sizes.

3. Bullying

Bullying is not a new problem within public school settings, but it is one that has a profound impact on the learning abilities of many students. Technology has given bullies more avenues to torment their victims – through social networking, texting and other virtual interactions – bullying extends beyond the normal school day. 

Cyberbullying has become a major issue for schools, as evidenced by the number of suicides that can be directly traced to bullying events. Parents, teachers and administrators are still unsure of how to legally handle such issues.

4. Technology

Interesting fact is that many students are more technologically advanced than many teachers. This poses a problem within public schools because it places current instructors at a decided disadvantage. 

The student’s passion for technology also tends to distract from their schoolwork. When teachers do not possess the skills to compete with the students’ various technological distractions, it may be difficult to keep students’ interest and attention.

Technology needs to come into the classroom to meet the learning demands of our society. Schools that are already cash-strapped may find an insurmountable challenge in coming up with the funding to bring computers and other forms of technology into their classes. 

5. Family Factors

Family factors also play a role in a teacher’s ability to teach students. Principals and teachers agree that what is going on at home will impact a student’s propensity to learn. Divorce, single parents, poverty and violence are examples of challenges a student may bring to school each day. 

While some teachers and administrators try to work with children in less-than-ideal family environments, they can only do so much – especially when parents are often not willing to partner with the schools to provide for the best interest of the child. 

6. Student Attitudes and Behaviors

Many public-school teachers cite student attitudes as a major problem facing today’s schools. The level of lethargy and disrespect for teachers continues to escalate and is pervasive in our society. 

The National Center for Education Statistics state problems like apathy, tardiness, disrespect and absenteeism pose significant challenges and to our classroom teachers and efficacy of our public schools.

7. Parent Involvement

Another common issue in public school is the level of parental involvement for students. Most teachers find there is no happy medium when it comes to parental involvement. 

Some parents won’t be seen for the entire school year, no matter what sort of issues might arise. Other parents never leave, hovering over the child and teacher – interfering with the education process. Parental involvement is crucial and highly encouraged in supporting their child’s needs in their education.

8. No Child Left Behind

Most administrators, parents and teachers view No Child Left Behind as a detriment to the public education environment. Our national political leaders are working to reform the NCLB policies but, unfortunately, the focus continues to be on the testing process. Student test scores are tapped as a measure to evaluate teacher performance. Hence, putting pressure on faculty in schools to “teach to the tests.”

Many teachers believe they are forced to teach to the annual standardized tests and activities like recess, lunch and exposure to the fine arts have been reduced to make more time for academics as a consequence of the testing procedures.

9. Student Health

Obesity has reached epidemic proportions in the United States and the same poor eating habits that led to obesity issues can also be attributing to lower student achievement. 

Obesity increases a student’s risk for other conditions; diabetes, high blood pressure, apathy, confidence with social engagement and interaction – all resulting in higher absenteeism and academic issues. 

Our public schools are doing a much-improved function in providing students with healthy nutritional quality standards and promoting more physical activity programs among students of all ages. As a country, we have a long way to go to fight this issue, and get on the road to better health.

10. Funding

In recent years, budget cuts have created huge problems for most public schools. Diminished funding means smaller staffs, fewer resources and fewer necessitated services. While throwing more money at our educational problems won’t make them disappear, the lack of funding has caused many of the issues.

6 Tips for Translating Educational Documents

The 6 Expert Tips

Translating educational documents, like diplomas, Individualized Education Programs (IEPs) and transcripts, helps K-12 schools communicate with students, families and the community.

At Pierian Spring Group, We believe in making the education document translation process easy and painless. Here are our 6 tips for translating education documents with an agency. 

1. Use a Consistent Tone

Using consistent tone when writing content is essential for effective communication. Consistent language not only helps with the document translation process, but it helps readers and translators understand your message more easily. It avoids confusion and prevents misinterpretations that can occur from using different terms or expressions.

Consistent language conveys professionalism and attention to detail. If the content written contains typos, it depicts a poor reflection on your school district. This level of professionalism instills trust in your intended audience.

2. Consider the Format

When drafting content that will be translated, it is important to consider text expansion for languages. K-12 schools must understand that languages such as Spanish and French can expand up to 20% when translated from English. This means that the language you translate to will take up 20% more space than the English translation.

3. Per Word Basis

While it may not be the only cost factor, document translations are charged on a per-word basis, so be sure to make your words count! The more words you have the more it is going to cost to translate the content. 

4. Create a Template

Templates are an excellent way for schools to save money, reducing the costs of translating educational documents. In addition, a template also keeps your content consistent and avoids redundancies. 

5. Add Notes to Your Document

Notes help translators. Many schools use parentheses inserted directly into the text or prefixing a comment with the abbreviation ‘TN’ or ‘t/n’ which stands for “Translator’s Note”.

Parental Involvement

Individuals with Disabilities Education Act (IDEA)
